»The Impact of Public International Law on the Cross-Border Investigation of Digital Evidence under the German Code of Criminal Procedure«: The dissertation deals with the problem that data relevant to investigations is often located on servers abroad and in the possession of foreign service providers, whereas law enforcement agencies are only allowed to carry out investigative measures within their own territory under public international law. The author examines how international law limits the possibilities of accessing data abroad and how violations of international law can lead to the inadmissibility of evidence.
Esther-Nicola Vehling studied law at the Albert-Ludwigs-University of Freiburg and at the Universitat Internacional de Catalunya in Barcelona from 2011 until 2017. She then completed an LL.M. degree in public international law at Utrecht University (NL) from 2017 to 2018. From 2018 to 2022, Ms. Vehling wrote her doctoral thesis. Simultaneously she worked as a research assistant at a law firm from 2018 to 2020. In 2021, Ms. Vehling started her legal clerkship at the High Court Berlin. In this context she trained at the Federal Ministry of Finance (customs investigation), at a large law firm for white-collar crime and at the Bundeskriminalamt (Federal Bureau of Investigation) in the cybercrime department.
