Extraterritorial Self-Defence in an Unwilling or Unable State
According to recent State practice, a State imperilled by non-State actors is entitled to the use of force within the territory of another State, if the latter is unwilling or unable to constrain the threats these non-State actors pose. The study therefore examines whether the so-called »unwilling or unable standard« can be considered as part of the existing body of international law, as it puts the ban on the use of force - a peremptory norm of general international law - to a particular test.

Paul D. Lorenz studied law at Goethe University Frankfurt. He is a research fellow at the Chair of Public Law and Philosophy of Law of Professor Uwe Volkmann and has been completing his legal clerkship at the District Court of Frankfurt am Main since 2020.
